BOOKING CONDITIONS

Senihati Art and Soul Tours

These Booking Conditions set out the terms and conditions by which Senihati Art and Soul Tours Pty Ltd ACN 676 267 584 (“Senihati” or “we” or “our”) will provide a Senihati Art and Soul Tour (a “tour”) for you and all persons named in your booking (including persons added or substituted after the booking is made) (“you” or “your”).

We rely upon your acknowledgement that you have read, understood and agree to be bound by these Booking Conditions, when we accept your booking request.

We reserve the right to change these Booking Conditions at any time prior to your booking a tour.

Booking

  1. To book a tour, you must complete a booking request online and provide a copy of the information page (photo page) of your passport.

  2. If we accept your booking request, we will issue you a booking confirmation together with an invoice for the tour price by email. The tour price will be due and payable 7 days after we issue the invoice. We reserve the right to cancel your booking if the tour price is not paid as per the invoice.

  3. Our legal obligation to provide the tour will arise on payment of the tour price.

  4. Amounts invoiced and payments must be made in Australian currency. Payments must be made via direct bank transfer. If a fee is charged by the payment system provider, then you will pay that fee in addition to the amount invoiced

  5. We reserve the right to reject your booking request, at our absolute discretion.

  6. Tour numbers are generally limited to a maximum of 10 persons. If we receive a booking request after a tour number limit is reached, we will offer you a place on another tour, if available.

  7. Prices are stated on our website. Prices stated are in Australian Dollars ($AUD) and are current at the time of publication. We reserve the right to alter the itinerary and tour price at any time before we issue a booking confirmation.

  8. For security reasons, airlines and our overseas suppliers require names to be given exactly as stated in your passport. If you do not provide the correct information and we have to re-issue airline tickets or other documentation, then you will be responsible for any amendment or re-issue fees charged in addition to our administration fees.

 

Services

The services we provide are:

(a)   the arrangement and coordination of your tour; and

(b)   the delivery of tour arrangements which we directly control.

The services include (often significant) work undertaken prior to the tour to arrange and coordinate the delivery of your tour.

Itinerary, tour price inclusions and exclusions

  1. We will provide the final itinerary for your tour when the tour price is paid.

  2. If you decide to undertake additional activities during the tour not specified in the final itinerary, then you will need to book these directly with the activity operator. We do not accept responsibility for those activities.

  3. The tour price includes air travel, accommodation charges, internal transfers, activities and meals as per the final itinerary.

  4. The tour price does not include baggage fees; beverages with meals or at other times, single room supplements, and services directly ordered such as room service, mini bar, laundry, post, telephone, internet, Wi-Fi charges, items of a personal nature or tips. Note that accommodation providers require validation of a credit card upon check in.

  5. The tour price also does not include costs associated with passports, visas, tourist tax, vaccinations, travel insurance premiums and excess, meals (other than those specified in the itinerary), emergency evacuation costs, and all items of a personal nature are not specified as included in the itinerary.

 

Amendments and cancellations (by you)

  1. We will endeavour to accommodate amendments and additional requests for your booking but cannot promise to fulfill them.

  2. A request to transfer to another tour may be treated as a cancellation if we are unable to find another person to take your place on the tour.

  3. We will charge an amendment of A$110 per person per amendment to cover administration costs for amendments you request to your booking. You will also be responsible to pay any additional charges charged by our suppliers. These may consist of non-refundable deposits and full amounts paid or payable to airlines, accommodation providers and ground operators for amendments.

  4. Amendments and cancellations must be notified in writing (by email) or by action, such as failing to arrive for or participate in the tour.

  5. Should you not participate in any part of the tour arrangements, no refund will be available for unused services.

  6. Should you choose to undertake additional activities not specified in the itinerary, then you will need to book these directly with the activity operator, at your own cost. We do not accept responsibility for the acts or omissions of the activity operator or for the activities.

 

Cancellation, rescheduling and alternative arrangements (by us)

  1. In these Booking Conditions, the term Force Majeure Event means an event or events beyond our control and which we could not have reasonably prevented, and includes but is not limited to:

(a) natural disasters (including not limited to flooding, fire, earthquake, landslide, volcanic eruption), adverse weather conditions (including hurricane or cyclone), high or low water levels;

(b) war, armed conflict, industrial dispute, civil strife, terrorist activity or the threat of such acts; epidemic, pandemic;

(c) any new or change in law, order, decree, rule or regulation of any government authority (including travel advisories and restrictions).

  1. If in our reasonable opinion (either directly or through our employees, contractors, suppliers or agents) we consider that your tour cannot safely or lawfully commence due to a Force Majeure Event then at our discretion we may elect to either:

  1. reschedule your tour (in whole or in part); or

  2. change the itinerary; or

  3. cancel your tour (in whole or in part).

    1. If in our reasonable opinion we (either directly or through our employees, contractors, suppliers or agents) consider that your tour cannot continue safely or lawfully due to a Force Majeure Event then at our discretion we may elect to either:

  1. provide other tour arrangements; or

  2. change the itinerary; or

  3. cancel the remainder of your tour.

  1. If due to a Force Majeure Event we cancel your tour or the remainder of your tour, we will refund the tour price attributable to the cancelled tour arrangements less:

  1. unrecoverable third party costs and other expenses incurred by us for the cancelled tour arrangements;

  2. administration charges incurred by us relative to the price of the cancelled tour arrangements; and

  3. fair compensation for work undertaken by us in relation to the cancelled tour arrangements until the time of cancellation and in connection with the processing of any refund.

  1. If we cancel your tour or the remainder of your tour, our contract with you to provide the services will be at an end.

  2. Other than the rights and responsibilities set out in these Booking Conditions, and subject to the Australian Consumer Law, neither of us will be responsible or liable to the other for provision of rescheduled tour arrangements, changed tour arrangements, other tour arrangements, changed itineraries or cancelled tour arrangements due to Force Majeure Events.

  3. Refunds for cancellations by us, irrespective of when the cancellation has been made, cannot be provided to you until our supplier has released the funds to us. This may take several months. 

  4. We may make changes to the itinerary, modes of transport, accommodation and the inclusions due to local circumstances beyond our reasonable control, such as road conditions, poor weather, changes in transport schedules, and/or vehicle breakdowns occurring prior to the commencement of the tour or during the tour. If so, we will notify you as soon as practicable and will try to put in place alternative arrangements for your benefit, which are acceptable to you. We will pass on any extra costs incurred.

  5. We strongly encourage you to purchase travel insurance that adequately responds to cancellation and rescheduling risks associated with Force Majeure Events. 

 

Travel Insurance

  1. You must take out personal travel insurance which provides comprehensive cover you for all activities and eventualities that may occur in undertaking the tour.

 

   2. We recommend you take out Comprehensive level Travel Insurance when we provide          the booking confirmation.

 

   3.The travel insurance should include cover for cancellation, medical and dental       expenses, repatriation, evacuation, loss and damage to baggage, public liability and loss of documentation. If you intend to engage in adventurous activities, the travel insurance policy exclusions should not exclude cover for those activities. 

   4.Check the status of the travel insurance with the travel insurer to ensure that travel to Bali and is not advice which is Level 3 - Reconsider your need to trave or Level 4 - Do not travel according to the current DFAT Travel Advice.

 

Safety, illness and vaccination

  1. Traveller safety is our priority. Senihati Art and Soul Tours has adopted the Covid Safe Travel Protocols released by the Council of Australian Tour Operators (CATO) and the World Travel & Tourism Council (WTTC) to ensure a high level of hygiene and safety on our tours.

  2. If due to any illness, suspected illness or failure to satisfy any required tests (such as a PCR or rapid antigen test in relation to Covid-19) or country specific vaccination requirements: 

•      an airline or other transport provider refuses you carriage; or

•      a hotel refuses to accommodate you; or

  • you are denied entry into Bali; or

  • we or our suppliers (acting reasonably) are unable to commence or continue your participation in the tour;

Then:

•      if you have not commenced your tour, we will treat it as an amendment request by       you; or

  • if you have already commenced your tour, we will provide you with reasonable assistance to arrange alternative travel arrangements, at your cost.

    1. You do not require proof of Covid 19 Vaccination to enter Bali. However, if you take prescription medication it is important to carry a signed declaration by your doctor outlining your need to have this medication in your possession. Please note: some medication is illegal to bring into Bali with or without a written declaration from your doctor. It is your responsibility to make the relevant enquiries with your medical practitioner and we take no responsibility for any penalties that you may incur for not following this advice.

    2. You must inform us and the providers of tour arrangements of any medical conditions which may affect your ability to participate in the tour.

    3. We reserve the right to cancel your booking or end your participation in the tour if any undisclosed medical conditions mean that you will require special assistance from our personnel which we cannot reasonably provide. We will not be liable for any damage, injury, death or loss of any kind arising from undisclosed medical conditions.

 

Dietary Requirements

Special dietary requests must be notified to us at the time of booking. Although we will use reasonable endeavours to accommodate requests, we cannot guarantee requests will be met by our suppliers. It is your responsibility to check that meals and beverages do not contain any allergens. We expressly disclaim any liability for meals or beverages that contain allergens.

Passports and Visas

It is a requirement that you hold a valid passport and any required visas for your tour. Your passport must have an expiry date of at least 6 months after the date of your expected return to Australia.

It is your responsibility to ensure that you are in possession of the necessary documentation to comply with the laws and regulations for entry to Bali. You must obtain the required eVisa as outlined on the website prior to departure. A Tourist Tax is payable and is to be completed online before travel. All costs associated are your responsibility.

Authority on Tour

When joining a group tour, you undertake to conduct yourself in a manner conducive to good group dynamics. If you act in a manner that threatens or disrupts the safety or enjoyment of others on the tour, the tour leader may, acting reasonably, require that you leave the tour. You will not be entitled to any refund for unused services and you will be responsible for any additional costs you incur.

Fitness To Travel Declaration

  1. At Senihati Art and Soul Tours, we pride ourselves on our ability to create unique, once in a lifetime small group tours that are filled with incredible experiences you might not be able to have on your own, or in a larger group. However, that does mean aspects of our itineraries can be challenging for some travellers. We want to make sure all travellers enjoy the tour, not struggle through it.

  2. The tour arrangements require that you are able to safely:

  • Walk for extended periods on pathways and roadsides that can be steep and uneven at times. This includes traversing steep, open terrain in rice terraces. Note* You can choose to opt out of this activity should you require. You will not be given any refund of the associated costs.

  • Regularly walk up multiple flights of stairs and short, steep hills

  • Stand for extended periods of time without needing to sit down, including in hot/humid climates

  • Carry your own luggage

  • Get on and off various modes of transport without assistance

 

Responsibility

  1. Where tour arrangements and services are supplied by independent suppliers, you acknowledge that our responsibly is limited to taking reasonable steps to select a reputable independent suppliers and arranging for them to provide tour arrangements to you. Independent suppliers include but are not limited to air carriers, transport providers, accommodation providers, and activity providers.

  2. To the fullest extent permitted by law, we will not be responsible to you or liable for any loss, damage, personal injury or delay attributable to the actions or omissions of an independent supplier. Any claims you have in this regard must be made against the independent supplier. You acknowledge that the independent supplier’s liability to you may be limited by their own terms and conditions.

  3. We are not responsible for any additional activities or excursions which are not included in the itinerary. Any advice or recommendation made by a guide or local representative relating to an additional itinerary does not make us responsible.

 

Acceptance Of Risk

  1. You acknowledge and accept that tour involves personal risks which may be greater than those present in your everyday life. These risks could be as a result of the adventurous nature of your tour activities or the visiting of destinations which present geographical, political or cultural risks and dangers.

  2. The risks present in the destination and places in the itinerary are described in the guidance provided by the Department of Foreign Affairs and Trade (DFAT). Visit www.smartraveller.gov.au/traveladvice. You acknowledge that your choice to travel is made having had the benefit of that guidance, and you accept any additional personal risks associated with your travel.

 

General Liability Limitation

To the extent only that we are the principal supplier to you of tour arrangements or other services which we control, then we will provide those travel arrangements and services with reasonable skill and care. We will be responsible for our employees in the course of their employment, and for our agents and suppliers who are carrying out the work we had asked them to do.

We will not be responsible for any loss, damage, claim or expense caused by the acts or omissions of yourself, of any other third party not connected with the provision of the tour arrangements or services.

We will not be responsible for any loss or additional expenses you incur for any missed connections/services attributable to delays in scheduled arrival or departure times, which are outside of our control.

Images

When on tour, we may take photographs, videos or make recordings of you and your activities that identify you. We reserve the right to use any images and/or recordings for promotional and marketing purposes. You consent to this use on a royalty free basis. If you do not consent to the use of your image or likeness, please advise us prior to the end of your tour.

 

Authority

If you place a booking on behalf of another party, you represent and warrant us that you are duly authorised to provide the agreement and consent of the other party to be bound by these Booking Conditions.

 

General

The contract between Senihati and you is governed by the laws of the State of South Australia. Any disputes shall be dealt with by a court with the appropriate jurisdiction in South Australia.

If any provision of these Booking Conditions is found to be unenforceable, then to the extent possible it will be severed without affecting the remaining provisions.

Any personal information you provide to us will be collected, stored, used, protected and shared in accordance with Australian Privacy Principles, and our Privacy Policy, which is published on our website.
